The summaries of cases for oral argument were prepared by Marc G. Perlin, Professor of Law at Suffolk University Law School. The summaries are not an official part of the court proceedings, and are presented so that those who access the website will have a general understanding of the legal issues in the cases set for oral argument.

Commonwealth v. Mazza
Criminal-- The defendant, convicted of murder in 1973, is appealing the denial of a motion for new trial on the ground of newly discovered evidence.

Commonwealth v. Buswell
Criminal-- Various issues arising out of conviction for child enticement involving on-line communications between the defendant and a law enforcement officer posing as a minor, including issues of entrapment.


Commonwealth v. Dalton
Sex Offender Registration-- The Commonwealth is appealing an order allowing the defendant, convicted of rape involving a child, relief from the obligation to register as a sex offender.


Gavin v. Tewksbury State Hospital
Massachusetts Tort Claims Act-- In a wrongful death action against the Commonwealth, whether a presentment letter sent prior to the appointment of a personal representative of the estate satisfied the provisions of the Massachusetts Tort Claims Act.


New England Forestry Foundation, Inc. v. Board of Assessors of the Town of Hawley

Commonwealth v. Powell
  (Reserve Case)
Confessions-- The Commonwealth is appealing a judge's ruling in a murder prosecution suppressing the defendant's confession; the case raises the question whether the court should reconsider a 1991 opinion regarding police interrogation of a defendant prior to arraignment.
